Another Legal Victory: Belgian Supreme Court Overturns Ban on Turban in Two Schools‏

13-year- old Sharanjit Singh was forced to remove his patka to attend a Belgian school for the past one year

18th Oct 2014, St Truiden, Belgium - The Belgian Conseil d'Etat has upheld the freedom of religion of Sikh students by overturning the ban on the Sikh Turban in two GO schools, which are a part of a large group of schools attended by many Sikh students in the Flemish part of Belgium.


"In two separate landmark decisions dated 14th Oct 2014, the Highest Administrative Court has held that GO has the obligation to organise its education without harming the respect for diversity and plurality," said Mejindarpal Kaur, International Legal Director of UNITED SIKHS,  an international advocacy NGO that has led the legal campaign to reverse the ban on the Sikh turban. 

Sharanjit Singh, (12 years old) and Sukhjot Singh (10 years old) brought separate actions in Sept 2013 against their respective GO schools for forcing them to remove their patka (a head covering worn by young Sikhs), which they are mandated to wear, at all times, as an integral part of their Sikh faith.
"Sharanjit is a rather shy boy, afraid of doing things wrong or being excluded. Following the ban he took off his patka very much to his distress. I am very happy that the Conseil d'Etat has overturned the ban and I hope my son will be able to put the past year behind him and look ahead to a good future ," Sharanjit Singh's father, Surjit Singh, said. 

"The Conseil d'Etat has claimed, in essence, that a school cannot simply impose a ban on wearing outward symbols of religious belief without having grounds for doing so ( such as disturbing the peace, proselytising, etc.). If a school nevertheless does this, it represents an excessive breach of the internationally protected fundamental right to religious freedom (art. 9 ECHR)," said Pieter Lagae, Sharanjit's lawyer, of the law firm of Van Steenbrugge & partners in Merelbeke,

In the decision, the Court emphasised repeatedly that Sharanjit and Sukhjot, and, by extension, Sikh students - had never displayed any such negative behaviour.

"We are grateful to all those who faithfully supported us and to the Conseil d'Etat for making this robust decision," said Amarjit Kaur, the President of UNITED SIKHS-Belgium.

Antim Ardas will be held at Gurdwara Sri Guru Singh sabha, F Block, KrIshna Nagar, Delhi – 51 on 22nd October,2014 between 11.30 to 12.30 pm. 

May Almighty give family enough strength to bear this huge loss.

40 tons of Relief Materials sent to Kashmir by DSGMC


 New Delhi: 20-10-14

Delhi Sikh Gurdwara Management Committee  sent 7 trucks loaded with 40 tonnes of relief material like rations, utensils and daily need goods to Jammu and Kashmir for the people affected by the recent floods.


After being cleared by Committee president Manjit Singh GK and General Secretary Manjinder Singh Sirsa trucks has been moved to Rajouri, Poonch,and to  Sri Nagar. After arrival of these trucks to Gurdwara Shaheed Bunga in Srinagar , relief  material will be provided to the needy under care of Advocate Davinder Singh Behl.

 

These trucks consists of  18 tons of rice, 9 tons of lentils, 4.5 tons of sugar, 900 kg Tea Powder, 168 kg dry milk, salty 1200 kg snacks, 850 kg of flour, 560 kg Maggie, 1200 packet biscuits, 1438 packet juice, a set of 50 mattresses, 50 bottles of mustard oil, 20 toothpaste, 188 small cooking pots, 100 plates, 530 bowls, 1000 teaspoons, 96 pairs footwear, 141 toothbrushes, 107 soap dishes and 30 bags full of clothes.


Kashmir Delhi Committee of disaster relief programs run by Vice President Tanavata Singh who is looking after the arrival of the content checks of financial assistance to families affected by the committee will soon send information/report on the matter. On this occasion, the committee's senior vice president Ravinder Singh Khurana, Joint Secretary, Harmeet Singh Kalka, senior Akali leader Avtar Singh interest, Onkar Singh Thapar, Kuldeep Singh bhogal, Kulmohan Singh, Delhi committee member Hardev Singh Dhanoa, Paramjit Singh Chandok, Chaman Singh and Leader Amarjit Singh were present.

The President of Delhi Sikh Gurdwara Management committee (DSGMC) Manjit Singh GK terming his ten days visit to Canada (which concluded on Sunday) as most successful, said that Shiromani Akali Dal would continue its fight for the rights of Sikhs living in the foreign countries within the legal and constitutional framework.

On being questioned, whether he endorse the idea of Khalistan, Manjit Singh GK replied that he is a proud Indian and take pride in the fact that Sikhs contributed in a large manner for the independence of India and the very facts is that country belongs to Sikhs. 

Our Gurus led the lives for universal brotherhood and communal harmony and fought for not only own rights but the rights of society at large irrespective of colour, creed and race. We must follow them,” he suggested.

“Sikhs are a martial community and nationalists, we fight for poor and the downtrodden,” Manjit Singh GK had told the Sikhs who met him in Canada reaffirming that DSGMC is completely dedicated to the Sikh ethos and traditions.

GK said that he replied to the questions of Canadian Sikhs on the basis of facts and made it clear that the wrong impressions about Shiromani Akali Dal and DSGMC among their minds were clarified as they were without basis.

Informing about the award ‘Human Rights Award Canada’ conferred on him, by ‘Save Professor Devinder Pal Singh Bhullar defence committee’, DSGMC president informed that Bhullar’s wife, Navneet Kaur Bhullar spoke in the program praising efforts of DSGMC. With the words of Navneet Kaur Sikhs in Canada realized the efforts made by the DSGMC and its president.

Manjit Singh GK also told the Canadian Sikhs that sitting in foreign countries and making adverse impressions is easy but working within frame work of a country takes time to fetch positive results. “This fight must continue for the Sikh Panth,” announced DSGMC president.
Manjit Singh GK called upon the Sikhs living in foreign countries to give a united fight for removing names of Sikhs from the Black list of Ministry of Home affairs, Indian visas to the Sikh families living in foreign countries, stopping racial attacks on the Sikhs living in foreign countries.

ਬੱਚਿਆਂ ਦੇ ਭਵਿੱਖ ਨੂੰ ਆਪਣੀ ਪਹਿਲੀ ਪ੍ਰਾਥਮਿਕਤਾ ਦੱਸਦੇ ਹੋਏ ਉਨ੍ਹਾਂ ਨੇ ਦਿੱਲੀ ਕਮੇਟੀ ਵੱਲੋਂ ਉਲੀਕੇ ਗਏ ਇਸ ਪ੍ਰੋਗਰਾਮ ਨੂੰ ਆਪਣੇ ਲਗਭਗ 900 ਅਧਿਆਪਕਾਂ ਤੱਕ ਪਹੁੰਚਾਉਣ ਦਾ ਵੀ ਅਹਿਦ ਲਿਆ। ਉਨ੍ਹਾਂ ਦਾਅਵਾ ਕੀਤਾ ਕਿ ਬਾਕੀ ਅਧਿਆਪਕਾਂ ਨੂੰ ਵੀ ਵੱਖ-ਵੱਖ ਸਮੇਂ ਤੇ ਇਸ ਟ੍ਰੇਨਿੰਗ ਕੋਰਸ ਨਾਲ ਜੋੜਿਆਂ ਜਾਵੇਗਾ। ਇਸ ਟ੍ਰੇਨਿੰਗ ਵਿਚ ਸਹਿਯੋਗ ਕਰਨ ਵਾਸਤੇ ਉਨ੍ਹਾਂ ਨੇ ਸ੍ਰੀ ਰਮਟੋਡ, ਚੇਅਰਮੈਨ ਹੇਲਗਾ ਟੋਡ ਫਾਉਂਡੇਸ਼ਨ ਅਤੇ ਬੀਬੀ ਐਲੀਜ਼ਾਬੇਥ ਟੇਲਰ ਦਾ ਵੀ ਵਿਸ਼ੇਸ਼ ਸਹਿਯੋਗ ਦੇਣ ਲਈ ਧੰਨਵਾਦ ਕੀਤਾ।
